EBOOKS.NG. (Referred to in this Privacy Policy as “we”, “us” or “our site”, “the site”) is committed to protecting your privacy. This Privacy Policy explains how we use the information we collect about you through EBOOKS.NG, how you can instruct us if you prefer to limit the use of that information and procedures that we have in place to safeguard your privacy. This Privacy Policy forms part of the Terms of Use.
We take the privacy of client and end user data very seriously. Any personal data collected from a client using the site, or disclosed to us during the use of our services is the property of that client. We will only process such data to the extent necessary to provide our services.
We will never sell, rent or disclose client data without the consent of a client, unless we have a legal obligation to do so.

- Introduction
2.1 This Privacy Policy covers the provision of the Services on EBOOKS.NG only and not any other website which you may access from the Site or by using our Services.
2.2 If we change the Privacy Policy we will place notices on the Site and post the changes on this page. If you do not accept any change to the Privacy Policy please stop using our services and inform us to delete your account.

3.1 We will only collect personal information about you that you have given, either:
(a) When you register to use any of our Services (as a ‘Client’); or
(b) When you make a purchase using the EBOOKS.NG platform (as a ‘Customer’).
3.2 When you register to use our Services or make a purchase you will be asked to provide personal information such as your name, e-mail address and contact telephone number(s).

4.1 If you register as a Client we may use personal information for: administrative, operational and marketing purposes and to communicate with you about your use of our Services or any changes to our Services. We will only pass on your information to other companies if it is necessary to perform our Services or with your prior consent. Those companies may contact you to inform you of their services and products. Any personal information that you choose to provide to us or to other companies using our Services will only be used in support of the intended purposes stated at the time at which it was collected and subject to any preferences indicated by you.
4.2 If you make a purchase through the EBOOKS.NG platform we will use your details solely for the purposes of processing your order and to service any support requests you make. We will not sell or rent your data. We will not disclose your data to third parties except to the extent required to fulfil your order and meet our legal obligations.
4.3 If you breach the Terms of Use, your personal information may be passed to third parties, such as our legal advisors to the extent necessary to enable those third parties to resolve the matter.
4.4 If this business is sold or integrated with another business, your details may be disclosed to our advisors and any prospective purchasers and their advisors and will be passed on to the new owners of the business.
4.5 We may be obliged to disclose your personal information if required to do so by law.

These terms and conditions apply to use of the EBOOKS.NG website and its services
- Interpretation
1.1 In these terms and conditions (“the Terms”):”Agreement” means the Client’s agreement to use the Services and pay the Charges subject to these Terms or as otherwise agreed; “Charges” means EBOOKS.NG’s charges for the Services as agreed between the parties. “Client” is the person to whom EBOOKS.NG is providing the Services pursuant to these Terms. “Data” means the Service’s data resulting from the processing of transactions by EBOOKS.NG (which may include sensitive personal data); “Intellectual Property” means any and all copyrights (including future copyrights), design rights, trademarks, service marks, domain names, trade secrets, know-how, database rights, and all other intellectual property rights, whether registered or unregistered, and including applications for any of the foregoing and all rights of a similar nature which may exist anywhere in the world or arising out of the EBOOKS.NG business model, the Material, the Trade Mark or the provision of the Services. “Material” includes, in addition to a document in writing, the Data, databases, computer software, designs, drawings, pictures or other images (whether still or moving), or any other record of any information in any form. “Customers” mean individuals who have placed an order for services through the EBOOKS.NG website. “Site” means the EBOOKS.NG website from which the Services can be accessed.
1.2 The headings in these Terms are for convenience only and shall not affect their interpretation.
1.3 The words “include” or “including” shall be construed without limitation to the words following.
1.4 Except where the context requires otherwise the singular includes the plural and vice versa; a reference to one gender includes all genders; words denoting persons include firms and corporations and vice versa.
2 Account Eligibility and Prohibitions
2.1 Eligibility. You must have an active account in order to use any of our services. You represent that you are at least 18 years old
2.2 Account Information; No Multiple Accounts. You must ensure that all information you provide in connection with establishing your account, such as your name, address and email are accurate when you provided them, and you must keep it up to date as long as you use the site. You may maintain only one account at a time. If we terminate your account, you will not establish a new account. You will not use false identities or impersonate any other person or use a username or password you are not authorized to use. You authorize us, directly or through third parties, to make any inquiries we consider appropriate to verify account information you provide.
2.3 Account Security. You are solely responsible for safeguarding and maintaining the confidentiality of your account username and password and you are responsible for all activities that occur in your account, whether or not you have authorized the activities. You may not permit any third party to use the site through your account and will not use the account of any third party. You agree to immediately notify EBOOKS.NG of any unauthorized use of your username, password or account.
Prohibitions
We do not accept offensive, illegal, pornographic, deceptive and copy right infringing contents. We reserve the right to make judgments about whether content is appropriate and to choose not to offer it
3 Book Distribution Rights.
3.1 Delivery, Acceptance and Withdrawal.
3.1.1. It is the responsibility of the Author that all materials (including, but not limited to images, diagrams, logos, data, as well as intellectual property in other media) supplied to EBOOKS.NG book publishing platform or e-book distribution platform by the client will have the relevant copyrights, licenses and permissions for use on the website. EBOOKS.NG book publishing services will not accept responsibility/liability for infringements caused by any wrongly supplied materials.
3.1.2 Delivery. You must provide to us, at your own expense a Microsoft word version of each manuscript you desire to publish through us or a pdf version of e-books you wish to sell through EBOOKS.NG . We will not return to you any electronic files or physical content or media you deliver to us in connection with our publishing services or e-book distribution services. You must deliver all electronic files free and clear of viruses, worms and other potentially harmful or disrupting codes.
3.1.3 Content Requirements. You must ensure that all manuscript
contents are in compliance with our book publishing policies at the time you submit them to us. If you discover that any content you have submitted does not comply, you must immediately withdraw the content by sending us email at info@ebooks.ng to un-publish it or by re-publishing content that complies. We are entitled to remove or modify the product description you provide for your manuscript for any reason, including if we determine that it does not comply with our content requirements. We may also remove all or any part of your Book’s cover art for any reason, including if we determine that it does not comply with our content requirements. You may not include in any manuscript any advertisements or other contents that are primarily intended to advertise or promote products or services.
3.1.4 Manuscript Rejection. We are entitled to determine what content we accept and distribute through the site in our sole discretion. If we request that you provide additional information relating to your manuscript, such as information confirming that you have all rights required to permit our publishing of the Manuscript, you will promptly provide the information requested, and you represent and warrant that any information and documentation you provide to us in response to such a request will be current, complete, and accurate. You authorize us, directly or through third parties, to make any inquiries we consider appropriate to verify your rights to permit our distribution of the manuscript and the accuracy of the information or documentation you provide to us with respect to those rights.
3.1.5 E-book Withdrawal. You may withdraw your e-book from further sales on the EBOOKS.NG website at any time on five working days advance notice by sending an email to info@ebooks.ng for book withdrawal. We may fulfill any customer orders completed through the date the e-book is available for sale. All withdrawals of Digital Books will apply prospectively only and not with respect to any customers who purchased the e-book prior to the date of removal.
3.2 Marketing and Promotion,
3.2.1 Marketing and Promotion. We will have sole discretion in determining all marketing and promotions related to the sale of your e-Book through the site and may, without limitation, market and promote your eBooks by making chapters or portions of your book available to prospective customers without charge, and by permitting prospective customers to see excerpts of your ebook in response to search queries. We will not owe you any fees for any marketing or promotional efforts. You acknowledge that we have no obligation to market, distribute, or offer for sale any book, or to continuing marketing, distributing or selling an eBook after we have commenced doing so.
3.3 Pricing.
3.3.1 Providing Your List Price. The list price you provide to us is referred to in this Agreement as your "List Price”. You will provide us your List Price exclusive of the VAT applicable to the customer. You may change your List Price by sending an email to info@ebooks.ng, and your change will be effective within 5 working days.
3.3.2 If your List Price for an e-book is higher than permitted under the Pricing rules, we will be entitled to deem it modified so that it is equal to the maximum List Price permitted when calculating Royalties due to you under this Agreement.
3.3.3 Currency Conversion. We may sell your eBook using multiple currencies. When we do, we will convert the List Price you submit to other currencies at an exchange rate we determine. We may periodically update the converted List Price in order to reflect current exchange rates Minimum List Prices to be accepted EBOOKS.NG for eBooks is N300 THREE HUNDRED NAIRA.
3.4 Royalties and Payments.
3.4.1 We are solely responsible for processing payments, payment collection, requests for refunds and related customer services, and have sole ownership and control of all data obtained from customers and prospective customers in connection with the EBOOKS.NG website.
3.4.2 Royalties. If you are not in breach of your obligations under this Agreement, for each e-book sold to customers through the EBOOKS.NG website, 60% of your list price will be paid to your registered bank account. We pay Royalties due on e-book sales approximately 30 days following the end of the calendar month during which the sales were made. At the time of payment, we will make available to you an online report detailing sales of e-books and corresponding Royalties.
3.4.3 As a registered author on the site, you must provide us with your bank account details during registration. Upon providing us with that bank account information, we will pay you Royalties for sales made on EBOOKS.NG.
3.4.4 Payment Disputes. You may not bring a suit or other legal proceeding against us with regard to any statement unless you bring it within three (3) months after the date the statement is made available. Any such proceeding will be limited to a determination of the amount of monies, if any, payable by us to you for the accounting periods in question, and your sole remedy will be the recovery of those monies with no interest.
3.4.5 If we terminate this Agreement because you have breached your representations and warranties or our Content Guidelines, you forfeit all royalties not yet paid to you. If after we have terminated your account you open a new account without our express permission, we will not owe you any Royalties through the new account.
3.4.6 Taxes. EBOOKS.NG is responsible for collecting and remitting any and all taxes imposed on their respective customers. You are responsible for any income or other taxes due and payable resulting from payments to you by EBOOKS.NG under this Agreement. Accordingly, unless otherwise stated, the amounts due to you hereunder are inclusive of any taxes that may apply to such payments.
3.5 Manuscript rejection. We may reject your manuscript if it does not comply with all reasonable directions of EBOOKS.NG, 80 % of the total fees paid for such manuscript will be refunded to your registered account 15 days after your submission date.
- Grant of Publishing and Distribution Rights.
4.1.1 You grant EBOOKS.NG, throughout the term of this Agreement, a nonexclusive, irrevocable, right and license to publish your book in print and electronic format, and distribute your e-book directly in encrypted PDF format by all digital distribution means available. This right includes, without limitation, the right to:
(a) Reproduce, index and store e-book on one or more computer facilities, and reformat, convert and encode e-book;
(b) Display, market, transmit, distribute, sell and otherwise digitally make available all or any portion of your digital or electronic book through the website (as defined below), for customers and prospective customers to download, access, and/or view online and offline, including on portable devices;
(c) Permit customers to "store" e-books that they have purchased from us and to access and re-download such e-books from time to time both during and after the term of this Agreement;
(d) Display and distribute (i) your trademarks and images in the form you provide them to us or within the manuscript (with such modifications as are necessary to optimize their viewing), and (ii) portions of your e-book, in each case solely for the purposes of marketing, soliciting and selling digital books
(e) use, reproduce, adapt, modify, and distribute, as we determine appropriate, in our sole discretion, to exercise the rights that you grant to us in this Agreement.
4.1.2 Rights Clearances and Rights Dispute Resolution. You will obtain and pay for any and all necessary clearances and licenses for your book to permit our exercise of the rights granted under this Agreement without any further payment obligation by us, including, without limitation, all royalties and other income due to any copyright owner.
4.1.3 Representations, Warranties and Indemnities. You represent and warrant that:
(a) You have the full right, power and authority to enter into and fully perform this Agreement and will comply with the terms of this Agreement;
(b) Prior to you or your designee's delivery of any content, you will have obtained all rights that are necessary for the exercise the rights granted under this Agreement;
(c) Neither the exercise of the rights authorized under this Agreement nor any materials embodied in the content nor its sale or distribution as authorized in this agreement will violate or infringe upon the intellectual property, proprietary or other rights of any person or entity, including, without limitation, contractual rights, copyrights, trademarks, common law rights, rights of publicity, or privacy, or moral rights, or contain defamatory material or violate any laws or regulations of any jurisdiction;
(d) You will ensure that all Manuscripts delivered to EBOOKS.NG comply with the technical delivery specifications provided by us; and
(e) you will be solely responsible for accounting and paying any co-owner or co-administrators of any manuscript or portion thereof any royalties with respect to the uses of the content and their respective shares, if any, of any monies payable under this Agreement. To the fullest extent permitted by applicable law, you will indemnify, defend and hold EBOOKS.NG its officers, directors, employees, harmless from and against any loss, claim, liability, damage, action or cause of action (including reasonable attorneys' fees) that arises from any breach of your representations, warranties or obligations set forth in this Agreement. We will be entitled, at our expense, to participate in the defense and settlement of the claim or action with counsel of our own choosing.
4.2 Copyright and Trademarks
4.2.1 It remains the Client’s responsibility to seek copyright protection if desired for any creative/intellectual property provided to the Client by the our Company.
4.2.2 The client represents to EBOOKS.NG and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to EBOOKS.NG are owned by the client, or that the client has permission from the rightful owner to use each of those elements, and will hold harmless, protect, and defend EBOOKS.NG from any claim or suit arising from the use of such elements furnished by the client.
4.2.3 If a third party asserts that a client did not have all rights required to make a book available through the EBOOKS.NG website, we may hold all Royalties due to such client until we reasonably determine the validity of the third party claim. If we determine that you did not have all of those rights or that you have otherwise breached your representations and warranties or our Content Guidelines with regard to book publishing and distribution, we will not owe you Royalties for that book and we may offset any of those Royalties that were previously paid against future Royalties, or require you to remit them to us.
4.3 Claims of Copyright Infringement
4.3.1 If you notify us through the procedure we provide on the EBOOKS.NG platform for making claims of copyright infringement that a third party has made an e-book available for distribution through EBOOKS.NG illegally, upon your request and after verification of your claim, we will pay you the Royalties due in connection with any sales of the e-book through EBOOKS.NG, and will remove the book from future sale on the website, as your sole and exclusive remedy.
- Supply of the Services & Support
5.1 Subject to earlier termination in accordance with these Terms, EBOOKS.NG shall provide the Services to the Client for the duration of this Agreement and will use its reasonable endeavors to provide the Services in a professional manner.
5.2 EBOOKS.NG uses a third party to: host the Site, the Software and the Data and to provide communication services. That third party undertakes to provide its services at or above industry standards. All parties rely upon the services of other telecommunications operators. Accordingly, EBOOKS.NG does not warrant that the Services will be uninterrupted or error free or that the delivery or e-mails or SMS text messages will be without delay.
5.3 EBOOKS.NG will endeavor to ensure that any third parties involved in the supply of the Services take appropriate security measures to protect Data.
5.4 It may be necessary to temporarily suspend the Services from time to time to carry out maintenance; such suspensions will be limited. However, the Services may also be suspended (in whole or part) where EBOOKS.NG or the third party host is obliged to comply with an order, instruction or request of government, a court or other competent administrative authority or an emergency service organisation.
5.5 EBOOKS.NG may at any time without notifying the Client make any changes to the Services which are necessary to comply with any relevant statutory, regulatory or similar requirements which do not materially affect the nature or quality of the Services.
5.6 EBOOKS.NG will provide e-mail support for the Services during its usual business hours free of charge.
5.7 Use of the EBOOKS.NG services requires the use of the services of a 3rd party payment processor, with which the Client must contract separately. The client acknowledges that EBOOKS.NG is in no way responsible for the actions or operations of the 3rd party processor.
- Charges
6.1 The Client shall pay the Charges for the Services in accordance with the payment terms agreed with EBOOKS.NG These terms include but are not limited to book setup fee for the activation each book and a fee for each product processed by the EBOOKS.NG platform for the client.
6.2 EBOOKS.NG may alter the level of Charges or the Charges payment terms from time to time on not less than 7 days’ notice. Within 7 days of receiving such notice the Client may contact EBOOKS.NG via email that it wishes to terminate this Agreement with effect from the date of any proposed change in the Charges. EBOOKS.NG may then either terminate the Agreement or withdraw its notice.
6.3 Payment of the Charges may be made by credit card or debit card. Or directly into our corporate account
- Client’s Obligations & Indemnity
7.1 The Client hereby undertakes to have, and keep EBOOKS.NG informed of a valid and regularly monitored contact e-mail address for the duration of this agreement. The Client will be deemed to have read notices sent to this contact e-mail address and EBOOKS.NG may act on that basis. Unless otherwise notified EBOOKS.NG at info@ebooks.ng
7.2 It is essential that the reputation of the Services and the EBOOKS.NG brand remain undamaged. Accordingly, it is a condition of this Agreement that the Client will not:
- a) in the sole opinion of EBOOKS.NG, use the Services so as to bring the service into disrepute or otherwise bring the Services or EBOOKS.NG into disrepute
(b) use the Services in a manner which is libelous ; or
(c) use the Services in a manner which infringes the intellectual property rights, proprietary or personal rights of any third party.
7.3 The Client will keep his password and other access details for use on EBOOKS.NG confidential. The Client shall notify EBOOKS.NG without delay if he believes that such information is no longer secret.
7.4 The Client shall indemnify EBOOKS.NGagainst any losses, claims, damages and expenses (including legal expenses) arising from any breach of this contract.
- EBOOKS.NG’s Warranties and Liability
8.1 EBOOKS.NG warrants to the Client that the Services will be provided using reasonable care and skill.
8.2 EBOOKS.NG shall have no liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any Data which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form or for any act or omission of a consumer.
8.3 EBOOKS.NG shall not be liable to the Client by reason of any representation (unless fraudulent), or any implied warranty, condition or other term (including those relating to satisfactory quality or fitness for purpose), or any duty at common law, or under the express terms of the Agreement, for (i)loss of profit, (ii)loss of revenue, (iii)loss of savings or anticipated savings, (iv)loss of data, (v)loss of use of software or data, (vi)loss or waste of management or staff time, (vii)any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of EBOOKS.NG prints and media, its servants or agents or otherwise) which arise out of or in connection with the provision of the Services or their use by the Client.
8.4 The entire liability of EBOOKS.NG under or in connection with the Agreement shall not exceed the amount of the Charges received by EBOOKS.NG from the Client in the preceding 3 months.
- Force Majeure
Neither party shall be responsible to the other party in circumstances where some or all of the obligations under the Agreement cannot be performed due to circumstances outside the reasonable control of the defaulting party, including an Act of God, change in legislation, fire, explosion, flood, accident, strike, lockout or other industrial dispute, war, terrorist act, riot, civil commotion, failure of public power supplies, failure of communication facilities, default of suppliers or sub-contractors, or the inability to secure computer processing facilities (including those of the necessary quality or security), obtain SMS text messaging services, obtain materials or supplies and, in all cases, the inability to do so except at increased prices (whether or not due to such causes). However, if such circumstances persist for more than 30 days, the non-defaulting party may terminate the Agreement and all Charges due to EBOOKS.NG up to the date of termination shall become due.
- Suspension and Termination
10.1 EBOOKS.NG may suspend the provision of Services to the Client if payment of any Charges is overdue (whether or not disputed by the Client).
10.2 EBOOKS.NG may suspend the Services (or any part thereof) at any time without notice if in the sole opinion of EBOOKS.NG the use of the Services by the Client damages, or threatens, to damage the security or stability of the Data, Site, Software, Member Services or other services provided by EBOOKS.NG to other clients.
10.3 Either party may terminate the Agreement on giving 1 month’s notice to the other via email.
10.4 EBOOKS.NG may suspend or terminate (at Soft prints and media’s sole discretion) the Agreement (and Services) forthwith on sending email to the clients registered email if: a) the Client breaches its obligations inclusive; or (c) if the Client commits any breach of these Terms and (if capable of remedy) fails to remedy the breach within 7 days after being required by email notice so to do; (c) if EBOOKS.NG is unable to continue providing the Services for reasons beyond its reasonable control.
10.5 Any termination of the Agreement for any reason shall be without prejudice to any other rights or remedies a party may be entitled to at law or under the Agreement
- Effects of termination
11.1 Upon termination of the Agreement for whatever reason: (a) there shall be no refund of any element of Charges; (b) all unpaid Charges shall become immediately due (including on a pro rata basis where part of a periodic charge charged in arrears is due); (c) EBOOKS.NG will be under no obligation to retain any Data; and (d) all provisions of the Agreement which in order to give effect to their meaning need to survive its termination shall remain in full force and effect thereafter including for the avoidance of doubt,
- Disputes
12.1 In the event of any dispute or difference arising between the parties in connection with this Agreement, senior representatives of the parties shall, within 30 days of notice being given by either party to the other, meet in good faith at a neutral venue of EBOOKS.NG’s choosing in Nigeria in an effort to resolve the dispute.
12.2 Any proceedings relating to any dispute shall take place in Nigeria and be conducted in the English language.
- General
13.1 Agreement Acceptance. You accept this Agreement and agree to be bound by its terms by either (a) clicking agree or accept where you're given the option to do so or (b) by using the website, or any part of it. If you don't accept the terms, you are not entitled to use the website. If the content owner is an entity, the individual person who accepts this Agreement for the Owner represents and warrants that he or she is entitled to enter this Agreement as an authorized representative of the owner and to bind The Owner to the terms of this Agreement.
1316.2 The Agreement constitutes the entire agreement between the parties, supersedes any previous agreement or understanding and may not be varied between the parties. The Client acknowledges that it has not relied upon any representations other than those contained in this Agreement. All other terms, expressed or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
13.3 The parties warrant that they have the power and authority to enter into the Agreement and perform its obligations under the Agreement.
13.4 The Agreement shall not be deemed to create any partnership or employment relationship between the parties.
13.5 Save for any holding company, subsidiary or associated company of EBOOKS.NG and any proprietor of the Intellectual Property, a person who is not party to the Agreement shall have no right or otherwise to enforce any term of the Agreement.
13.6 If any provision of these terms is held by any court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and the remainder of the provision in question shall not be affected.
13.7 The Agreement shall be considered to be a contract made in Nigeria and Nigerian law shall apply in all respects to this Agreement and the parties agree to submit to the exclusive jurisdiction of the Nigerian courts.

Book Returns
1. There is no return of any e-book purchased on EBOOKS.NG
2. If you have purchased the printed version of any book and would want to return for any reason, You have 5 calendar days to return a book from the date you received it.To be eligible for a return, the book must be unused and in the same condition that you received it.The book must be in the original packaging.Your book needs to have the receipt or proof of purchase
Book Refunds
Once we receive your book, we will inspect it and notify you that we have received your returned book. We will immediately notify you on the status of your refund after inspecting the item.
If your return is approved, we will initiate a refund of 70% of the total amount paid to your specified bank account.You will receive the credit within 3 days.
Shipping
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are nonrefundable
Refund for other services
